J-1

Exchange Visitor Visa

TVP guides this

Who it is for

Teachers, trainees, researchers, and other exchange visitors coming to the US through a State Department-designated sponsor program.

Typical timeline

3-6 months from sponsor acceptance to US arrival

How it works

  • You apply through a designated J-1 sponsor organization (not TVP - we guide you to the right one)
  • Sponsor issues your DS-2019 Certificate of Eligibility
  • You apply for the J-1 visa at a US embassy or consulate in the Philippines
  • Program duration varies: teachers up to 5 years, trainees typically 12-18 months

TVP notes

This is the pathway TVP knows from the inside. Janice went through the J-1 process as a Filipino professional. We can walk you through what the paperwork actually looks like, what surprises you at each stage, and how to be ready before you approach a sponsor.

Important: J-1 does not lead to permanent residency on its own. Some J-1 participants are subject to a 2-year home country return requirement before changing status. This is critical to understand before you start.
H-1B

Specialty Occupation Visa

TVP refers out for this

Who it is for

Degree-holding professionals in specialty fields: IT, finance, accounting, engineering, architecture, and similar.

Typical timeline

6-12 months from employer agreement to work authorization

How it works

  • Your US employer must sponsor you and file an H-1B petition
  • Subject to annual lottery: 65,000 regular cap + 20,000 US master's degree cap
  • Lottery registration opens in March each year for an October 1 start date
  • Requires a US bachelor's degree or equivalent (foreign degree evaluation accepted)

TVP notes

Highly competitive due to the lottery. If you have a US employer interested in sponsoring you, they need to understand the cost and timing commitment before you both invest in it.

Important: TVP can help you understand whether H-1B likely fits your profile and what an employer needs to consider. For the actual petition strategy and filing, you need a licensed immigration attorney.
EB-3

Skilled Worker Green Card

TVP refers out for this

Who it is for

Skilled workers (2+ years experience), professionals with a US bachelor's degree equivalent, or other workers in roles with no qualified US workers available.

Typical timeline

2-10+ years depending on Philippines-born priority date backlog

How it works

  • Employer files PERM labor certification with the Department of Labor
  • Employer then files I-140 immigrant petition with USCIS
  • Priority date assigned - Philippines has a significant backlog for EB-3
  • Once priority date is current: adjustment of status (if in US) or consular processing

TVP notes

Slower than J-1 or H-1B but leads directly to a green card. The right long-term strategy if you plan to stay in the US permanently. The Philippines backlog is real - understand the timeline before you start.

Important: This requires an immigration attorney for the PERM and I-140 process. TVP can explain the pathway and help you understand if you and your employer are realistic candidates before you pay attorney fees to find out.
O-1

Extraordinary Ability Visa

TVP refers out for this

Who it is for

Individuals with demonstrated extraordinary ability or achievement in their field - requires documented recognition, not just strong performance.

Typical timeline

3-6 months

How it works

  • US employer or agent must petition on your behalf
  • Must demonstrate extraordinary ability: awards, publications, judging roles, high salary, media coverage, etc.
  • 3 of 10 regulatory criteria must be met
  • Valid for up to 3 years, renewable in 1-year increments

TVP notes

The bar is genuinely high - this is not 'very good at your job,' it is nationally or internationally recognized. If you have that level of documented recognition, the O-1 has no annual cap and no lottery.

Important: Determining whether you actually meet the criteria requires an attorney's assessment. TVP can give you a general read on fit, but the formal eligibility analysis is legal work.
EB-1A

Extraordinary Ability (Self-Petition)

TVP refers out for this

Who it is for

Top-tier professionals with sustained national or international recognition in sciences, arts, education, business, or athletics.

Typical timeline

6-12 months if approved

How it works

  • Self-petition - no employer sponsor required
  • Must meet 3 of 10 USCIS criteria with documented evidence
  • No priority date backlog for Philippines (currently)
  • Direct path to green card

TVP notes

The highest bar of any employment-based category, but the only one with no employer requirement and no Philippines backlog. If you have the documented recognition, it is worth exploring.

Important: Requires an immigration attorney. TVP's role here is helping you understand whether the category is worth pursuing before you invest in attorney time.
Family

Family-Based Immigration

TVP refers out for this

Who it is for

Immediate relatives of US citizens (spouse, child, parent) or family preference categories (adult children, siblings).

Typical timeline

6 months to 20+ years depending on category and relationship

How it works

  • US citizen or lawful permanent resident petitioner files I-130
  • Immediate relatives of US citizens: no annual cap, fastest processing
  • Family preference categories: subject to annual limits and significant backlogs for Philippines

TVP notes

If you have a qualifying US citizen or green card holder family member, this may be your most direct path - depending on the relationship and the backlog in your specific category.

Important: Strategy and timing on family-based cases matters significantly. This requires a licensed immigration attorney.
